These Terms & Conditions ("Terms") govern your use of the Moksha mobile application ("App"), operated by Moksha Foundation ("Moksha," "we," "us"). By creating an account or using the App, you agree to these Terms.
1. ELIGIBILITY
You must be at least 18 years old to use the App. By registering, you confirm that you are 18 or older.
2. NATURE OF THE SERVICE — PLEASE READ CAREFULLY
Moksha offers two distinct types of support and it is important you understand the difference:
- Good Listener sessions are peer support conversations. Good Listeners are not licensed mental health professionals and these sessions are not therapy, counselling or medical treatment of any kind.
- Therapist sessions connect you with independently licensed mental health professionals. Moksha is a technology platform that facilitates the connection and does not itself provide medical or clinical care and is not responsible for the professional advice given by any Therapist.
- The AI Companion is an automated feature powered by third-party AI technology (Google Gemini). It is not a human, not a medical device, not a substitute for professional help and may produce inaccurate or inappropriate responses. Do not rely on it for medical, psychiatric or emergency decisions.
3. EMERGENCY AND CRISIS SITUATIONS
Moksha is NOT an emergency service. If you are experiencing a medical emergency or are in crisis, including thoughts of self-harm or suicide, do not use the App — contact your local emergency services immediately or a crisis helpline such as India's KIRAN helpline (1800-599-0019) or iCall (9152987821). Our in-app safety prompts are a supplementary measure only and are not guaranteed to reach you in time or prevent harm.
4. ACCOUNT REGISTRATION AND SECURITY
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use at contact@weseetheunseenfoundation.com
5. USER CONDUCT
You agree not to: impersonate any person; harass, abuse or threaten other users or professionals; share content that is unlawful, obscene or harmful; attempt to circumvent the App's safety or moderation systems; or use the App for any purpose other than its intended personal use. We may suspend or terminate accounts that violate these Terms, with or without notice, at our discretion.
6. FEES AND PAYMENTS
Certain sessions may require payment, which will be clearly disclosed to you before you confirm a booking. Payment terms, cancellation and refund policies applicable at the time of booking will govern that transaction.
7. INTELLECTUAL PROPERTY
The App, its design and its content (excluding user-generated content and content from Good Listeners/Therapists) are owned by Moksha Foundation and protected by applicable intellectual property laws. You may not copy, modify or distribute any part of the App without our written permission.
8. DISCLAIMER OF WARRANTIES
The App is provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free or that any Good Listener, Therapist or the AI Companion will meet your expectations or needs.
9. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Moksha Foundation shall not be liable for any indirect, incidental, special or consequential damages or for any outcome arising from your interactions with Good Listeners, Therapists or the AI Companion, including any clinical or professional advice given by a Therapist, who acts independently of Moksha.
10. INDEMNIFICATION
You agree to indemnify and hold Moksha Foundation harmless from any claims, damages or expenses arising from your violation of these Terms or misuse of the App.
11. TERMINATION
We may suspend or terminate your access to the App at any time, for violation of these Terms or for any other reason, including at our sole discretion for safety reasons. You may stop using the App and delete your account at any time (see the Account Deletion policy).
12. CHANGES TO THESE TERMS
We may update these Terms from time to time. Material changes will be notified in the App and continued use after such changes constitutes your acceptance.
13. GOVERNING LAW
These Terms are governed by the laws of India, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of India.
